12 - Chapter on the Requirement of Jihad by the Command and Permission of the Imam, and the Prohibition of Jihad with a Non-Just Imam
19954 (1) - Muhammad ibn Ya'qub, from Muhammad ibn Yahya, from Muhammad ibn al-Husayn, from Ali ibn al-Numan, from Suwayd al-Qallā’, from Bishr, from Abu Abdullah (peace be upon him). He said: I said to him: I saw in a dream that I said to you that fighting with anyone other than the Imam whose obedience is obligatory is forbidden like carrion, blood, and pork. You said to me: Yes, it is so. Abu Abdullah (peace be upon him) said: It is so, it is so. And from Muhammad ibn al-Hasan al-Tā’ī, from the one he mentioned, from Ali ibn al-Numan, from Suwayd al-Qallā’, from Bishr al-Dahhān, similarly.
19955 (2) - And from Ali ibn Ibrahim, from his father, from Ibn Abi Umayr, from al-Hakam ibn Miskin, from Abd al-Malik ibn Amr. He said: Abu Abdullah (peace be upon him) said to me: O Abd al-Malik, why do I not see you going to those places where the people of your land go? I said: Where? He said: Jeddah, Abadan, al-Musisah, and Qazvin. I said: Awaiting your command and following you. He said: By Allah, if it were good, they would not have preceded us in it. I said to him: The Zaydites say there is no difference between us and Ja'far except that he does not see jihad. He said: Do I not see it?! By Allah, I do see it, but I hate to abandon my knowledge to their ignorance. And Sheikh narrated it with his chain from Muhammad ibn Ya'qub and likewise the previous one.
19956 (3) - And from him, from his father, from Uthman ibn Isa, from Sama'ah, from Abu Abdullah (peace be upon him). He said: Abad al-Basri met Ali ibn al-Husayn (peace be upon him) on the way to Mecca. He said to him: O Ali ibn al-Husayn, you have left jihad and its hardship and turned to Hajj and its ease. Indeed, Allah, the Almighty, says: "Indeed, Allah has purchased from the believers their lives and their properties [in exchange] for that they will have Paradise. They fight in the cause of Allah" (Qur'an 9:111). Ali ibn al-Husayn (peace be upon him) said: Complete the verse. He said: "The repentant, the worshippers" (Qur'an 9:112). Ali ibn al-Husayn (peace be upon him) said: When we see those who have these characteristics, jihad with them is better than Hajj. And it was narrated by al-Tabarsi in "Al-Ihtijaj" without a chain of transmission, and by Ali ibn Ibrahim in his Tafsir from his father, from his men, from Ali ibn al-Husayn (peace be upon him) similarly.
19957 (4) - And from Muhammad ibn Abi Abdullah and Muhammad ibn al-Hasan, from Sahl ibn Ziyad, and from Muhammad ibn Yahya, from Ahmad ibn Muhammad, all from al-Hasan ibn al-Abbas ibn al-Juraysh, from Abu Ja'far al-Thani (peace be upon him) in a long hadith about "Indeed, We sent it down" (Qur'an 97:1). He said: And I do not know of any jihad in this time except Hajj, Umrah, and living in the land of the sacred house.
19958 (5) - And from several of our companions, from Sahl ibn Ziyad, from Ahmad ibn Muhammad ibn Abi Nasr, from Muhammad ibn Abdullah, and from Muhammad ibn Yahya, from Ahmad ibn Muhammad, from al-Abbas ibn Ma'ruf, from Safwan ibn Yahya, from Abdullah ibn al-Mughirah. He said: Muhammad ibn Abdullah said to al-Rida (peace be upon him) while I was listening: My father told me from his family, from his forefathers, that some of them said: In our land there is a place called Qazvin, and an enemy called al-Daylam. Is there any jihad or guard duty? He said: Hold to this house and perform Hajj. He repeated the question, and he said: Hold to this house and perform Hajj. Is it not enough for one of you to be in his house, spending on his family from his own means, awaiting our command? If he reaches it, it is as if he was with the Messenger of Allah (peace be upon him) at Badr. If he dies awaiting our command, it is as if he was with our Qa'im (peace be upon him) in his tent, and he gathered between his index fingers. I do not say: thus, and he gathered between his index and middle fingers, for this one is longer than that one. Abu al-Hasan (peace be upon him) said: He spoke the truth.
19959 (6) - Muhammad ibn al-Hasan with his chain from Muhammad ibn al-Hasan al-Saffar, from al-Hasan ibn Musa al-Khashab, from Abu Tahir al-Warraq, from Rabi' ibn Sulayman al-Khazzaz, from a man, from Abu Hamza al-Thumali. He said: A man said to Ali ibn al-Husayn (peace be upon him): You have turned to Hajj and left jihad, finding Hajj easier for you. Allah says: "Indeed, Allah has purchased from the believers their lives and their properties" (Qur'an 9:111). Ali ibn al-Husayn (peace be upon him) said: Recite what follows it. He recited: "The repentant, the worshippers, the praisers..." (Qur'an 9:112). Ali ibn al-Husayn (peace be upon him) said: When these appear, we do not prefer anything over jihad.
19960 (7) - And with his chain from al-Haytham ibn Abi Masruq, from Abdullah ibn al-Musaqqaq, from Muhammad ibn Abdullah al-Samandari. He said: I said to Abu Abdullah (peace be upon him): I am at the door—meaning the door of the doors—and they call for arms, so I go out with them. He said: What if you go out and capture a man and give him safety and make for him a covenant like the Messenger of Allah (peace be upon him) made for the polytheists? Would they fulfill it for you? I said: No, by Allah, may I be your ransom, they would not fulfill it for me. He said: Then do not go out. Then he said to me: There, indeed, is the sword.
19961 (8) - Muhammad ibn Ali ibn al-Husayn in "Al-Ilal" from his father, from Sa'd, from Muhammad ibn Isa, from al-Qasim ibn Yahya, from his grandfather al-Hasan ibn Rashid, from Abu Basir, from Abu Abdullah, from his forefathers (peace be upon them). He said: The Commander of the Faithful (peace be upon him) said: A Muslim does not go out for jihad with one who does not believe in the judgment, nor does he execute the command of Allah in the booty. If he dies in that place, he would be helping our enemy in holding back our right and spreading our blood, and his death would be a death of ignorance. And in "Al-Khisal" with his chain from Ali (peace be upon him) in the Four Hundred Hadith similarly.
19962 (9) - And with his chain from al-A'mash from Ja'far ibn Muhammad (peace be upon him) in the Sharia of Religion. He said: Jihad is obligatory with a just Imam, and whoever is killed defending his property is a martyr.
19963 (10) - Al-Hasan ibn Ali ibn Shu'bah in "Tuhaf al-Uqul" from al-Rida (peace be upon him) in his book to al-Ma'mun. He said: Jihad is obligatory with a just Imam, and whoever fights and is killed defending his property, his family, or his life is a martyr. It is not permissible to kill any of the disbelievers in the land of taqiyya except a fighter or an oppressor, and that is if you do not fear for yourself. Nor is it permissible to consume the wealth of the people, whether they are dissenters or others, and taqiyya in the land of taqiyya is obligatory. There is no perjury on one who swears by taqiyya to ward off oppression from himself. I say: And what indicates that has been previously mentioned and what will be mentioned. 12 - باب اشتراط وجوب الجهاد بأمر الإمام واذنه، وتحريم الجهاد مع غير الإمام العادل (19954) 1 - محمد بن يعقوب، عن محمد بن يحيى، عن محمد بن الحسين، عن علي بن النعمان، عن سويد القلاء، عن بشير (1) عن أبي عبد الله (عليه السلام) قال: قلت له: إني رأيت في المنام أني قلت لك إن القتال مع غير الامام المفترض طاعته حرام مثل الميتة والدم ولحم الخنزير فقلت لي: نعم هو كذلك، فقال أبو عبد الله (عليه السلام): هو كذلك هو كذلك وعن محمد بن الحسن الطائي، عمن ذكره، عن علي بن النعمان، عن سويد القلاء، عن بشير الدهان مثله (2)
(19955) 2 - وعن علي بن إبراهيم، عن أبيه، عن ابن أبي عمير، عن الحكم بن مسكين عن عبد الملك بن عمرو قال: قال لي أبو عبد الله (عليه السلام): يا عبد الملك مالي لا أراك تخرج إلى هذه المواضع التي يخرج إليها أهل بلادك؟ قال: قلت: وأين؟ قال: جدة وعبادان والمصيصة وقزوين، فقلت: انتظارا لامركم والاقتداء بكم، فقال: اي والله لو كان خيرا ما سبقونا إليه، قال: قلت: له: فان الزيدية يقولون ليس بيننا وبين جعفر خلاف إلا أنه لا يرى الجهاد، فقال: أنا لا أراه؟! بلى والله إني لأراه ولكني أكره أن أدع علمي إلى (1) جهلهم ورواه الشيخ بإسناده عن محمد بن يعقوب (2) وكذا الذي قبله (19956) 3 - وعنه، عن أبيه، عن عثمان بن عيسى، عن سماعة، عن أبي عبد الله (عليه السلام) قال: لقى عباد البصري (1) علي بن الحسين (عليه السلام) في طريق مكة، فقال له: يا علي بن الحسين تركت الجهاد وصعوبته، وأقبلت على الحج ولينه، إن الله عز وجل يقول: * (ان الله اشترى من المؤمنين أنفسهم وأموالهم بأن لهم الجنة يقاتلون في سبيل الله) * (2) الآية فقال علي بن الحسين (صلوات الله عليه): أتم الآية فقال * (التائبون العابدون) * الآية، فقال علي بن الحسين (عليه السلام): إذا رأينا هؤلاء الذين هذه صفتهم فالجهاد معهم أفضل من الحج
